All merchants within the meaning of the German Commercial Code are obliged to archive – that is, partnerships and corporations. E-mails relevant for tax purposes (GoBD) must also be retained in unalterable form.
Commercial and business letters: 6 years. Accounting documents and tax-relevant correspondence: 10 years. The retention period begins at the end of the calendar year in which the document was created.
The GoBD (German principles for the proper keeping and retention of books) require completeness, accuracy, immutability and traceability. E-mails must be stored in their original form and remain legible at all times.
